Daniel S. WeingerOf-counsel attorney Daniel Weinger joined the firm in 2016. He has been practicing as an appellate attorney in South Florida since 1999. Mr. Weinger has been involved with hundreds of appeals over the past eighteen years through a combination of his activities as a career attorney at the Third District Court of Appeal and in the private sector as the lead appellate attorney at Conrad & Scherer, LLP, and as the president of his own practice, the Weinger Appellate Firm.

After graduating magna cum laude from Nova Southeastern University’s Shepard Broad Law Center in 1999, Mr. Weinger spent over five years at the Third District Court of Appeal, where he served as the court’s sole central staff attorney. In that capacity, Mr. Weinger spent the majority of his time working for one judge at a time for extended periods depending on need, workflow, and the unexpected departure or temporary leave of other staff attorneys. Mr. Weinger also served as the sole staff attorney for the court’s many visiting judges, most of whom came from the other districts throughout the state. Because of the unconventional nature of Mr. Weinger’s role at the court, he worked closely with, and directly for, more than a dozen appellate court judges, including some of the most respected jurists in Florida history. The experience gives Mr. Weinger unique insight into the various methods that different judges use when deciding a case on appeal.

Following his tenure at the Third District Court of Appeal, Mr. Weinger entered private practice, spending the better part of the next decade first as an associate and then as a partner and lead appellate counsel at the Fort Lauderdale law firm of Conrad & Scherer, LLP.

In addition to overseeing the firm’s appellate practice, Mr. Weinger headed up the litigation support team on some of the highest profile Broward County cases of the last few years. Most notably, Mr. Weinger led a litigation support team of attorneys and paraprofessionals in the representation of a diverse group of plaintiffs seeking recovery of over $225 million in investor losses resulting from a multi-billion dollar structured settlement Ponzi scheme orchestrated by Scott Rothstein, including co-authoring a two thousand-plus count Complaint, one of the largest in the history of Florida jurisprudence. This nationally-publicized case focused on a bank’s role in facilitating this criminal enterprise, asserting novel claims that the bank willfully aided and abetted the Ponzi fraud. After years of litigation, the matter was resolved through settlement resulting in one of the highest percentages of recovery for victims entangled in a Ponzi scheme.

Additionally, Mr. Weinger represented the wife and children of a well-known missing entrepreneur and philanthropist in a dispute with other family members. This Broward County Probate Court case involved legal issues of the highest complexity concerning the absentee’s estate, including property rights related to the absentee’s extensive personal property and real estate holdings across the globe.

More recently, just prior to joining The Law Offices of Robin Bresky, in the case of De Gazelle Group, Inc. v. Tamaz Trading Establishment, 817 F.3d 747 (11th Cir. 2016), Mr. Weinger served as Appellate counsel for a Saudi Arabian defendant in an appeal from an order denying its motion to set aside a $2,500,000.00 default judgment. In that case, Mr. Weinger successfully obtained a reversal from the Eleventh Circuit Court of Appeals which, as a result of the arguments raised in the briefs, issued a published opinion creating new precedent in the circuit.
